Le Parlement ach\u00e8ve ainsi l&#8217;examen d&#8217;un texte port\u00e9 par le d\u00e9put\u00e9 de Guadeloupe <strong>Max Mathiasin<\/strong>, 341 ans apr\u00e8s l&#8217;\u00e9dit de mars 1685. Le scrutin a compt\u00e9 320 voix pour, aucune contre et 18 abstentions, toutes issues du groupe communiste r\u00e9publicain citoyen et \u00e9cologiste Kanaky. Faute de modification, la proposition de loi est d\u00e9finitivement adopt\u00e9e.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fd7ac13 elementor-widget elementor-widget-text-editor\" data-id=\"fd7ac13\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Cinq amendements soumis \u00e0 scrutin public, d\u00e9pos\u00e9s par les groupes socialiste et communiste, ont \u00e9t\u00e9 rejet\u00e9s. Le texte reste donc identique \u00e0 celui des d\u00e9put\u00e9s. La commission des lois du S\u00e9nat avait arr\u00eat\u00e9 sa version le 14 octobre, six jours avant la s\u00e9ance publique. Sa promulgation doit intervenir dans un d\u00e9lai maximal de quinze jours, sauf saisine du Conseil constitutionnel. Le rapporteur du S\u00e9nat, <a href=\"https:\/\/fr.wikipedia.org\/wiki\/Louis_Vogel\" target=\"_blank\" rel=\"noopener nofollow\">Louis Vogel<\/a>, a relev\u00e9 que l&#8217;abrogation implicite du Code noir faisait peu de doute. Jean-Claude Nelson, neuvi\u00e8me vice-pr\u00e9sident de la r\u00e9gion Guadeloupe, avait attir\u00e9 l&#8217;attention du d\u00e9put\u00e9 sur ce point. Les deux \u00e9lus d\u00e9cident d&#8217;agir. La proposition de loi est d\u00e9pos\u00e9e \u00e0 l&#8217;Assembl\u00e9e nationale le 16 septembre 2025, avec 130 cosignataires. La commission des lois l&#8217;approuve \u00e0 l&#8217;unanimit\u00e9 le 20 mai 2026. Le 21 mai, jour des 25 ans de la loi Taubira, le Gouvernement engage la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e. Les d\u00e9put\u00e9s l&#8217;adoptent le 28 mai. Max Mathiasin en \u00e9tait aussi le rapporteur devant la commission des lois de l&#8217;Assembl\u00e9e nationale. Pour Max Mathiasin, ces textes restaient dans \u00ab l&#8217;ombre de notre droit \u00bb. Le Code noir tombe alors en d\u00e9su\u00e9tude, sans jamais avoir \u00e9t\u00e9 formellement abrog\u00e9. C&#8217;est ce paradoxe que <a href=\"https:\/\/richeskarayib.com\/fr\/abrogation-code-noir-memoire-esclavage\/\">notre article de mai 2026<\/a> d\u00e9taillait avant le vote des d\u00e9put\u00e9s. Sur le plan juridique, le vote du S\u00e9nat est essentiellement symbolique, puisque le Code noir n&#8217;a plus aucun effet.
